The Approved Solar Retailer program has now been replaced by the New Energy Tech Consumer Code (NETCC) program. The Clean Energy Council are still investigating complaints against Approved Solar Retailers relating to incidents that occurred before 1 February 2023. For incidents after 1 February 2023 complaints are handled through the New Energy Tech Consumer Code (NETCC) program.

If an applicant or signatory believes that the Code Administrator did not exercise reasonable discretion, that they were denied natural justice, or that new evidence has come to light that was not available at the time of an original determination, they are entitled to appeal the determination of the Code Administrator to the Code Review Panel, or its delegate.

All appeals must be lodged within 30 days of being notified by the Code Administrator of its decision. All decisions by the Code Review Panel are binding.

Application appeals

Pursuant to section 4.1 of the Solar Retailer Code of Conduct (the Code), the Code Administrator will make an assessment as to whether the application sufficiently demonstrates that the applicant retailer complies with the Code and has the systems and procedures in place to ensure ongoing compliance.

Where the Code Administrator finds that an application does not meet the requirements of the Code, the Code Administrator has the right to decline an application.

An applicant may appeal the Code Administrator’s determination to the Code Review Panel or its appointed delegate (see section 4.2 of the Code) by completing an Application Appeals form, paying a non-refundable fee of $750 (excl. GST) and sending it within 30 days of being notified by the Code Administrator of its decision, to:

An invoice of $750 (excl. GST) will be issued on receipt of this appeals form. Upon payment, the appeal will be referred to the Code Review Panel or its appointed delegate for their consideration.

Compliance appeals

Pursuant to sections 3.5.1 and 3.5.2 of the Solar Retailer Code of Conduct (the Code), the Code Administrator will investigate alleged breaches of the Code by signatories.

Where the Code Administrator finds that an Approved Solar Retailer has breached the Code, the Code Administrator can, pursuant to section 3.5.2(d) of the Code, allocate a sanction or recommend a course of action to the Code Review Panel.

An Approved Solar Retailer may appeal the Code Administrator’s determination to the Code Review Panel (see section 3.7 of the Code) by completing a Compliance Appeals form and sending it within one month of being notified by the Code Administrator of its decision, to:
